Presidential Pardon for attempted assassin

sdrh1The ex-LTTE combatant who was convicted for making an abortive attempt on the life of President Maithripala Sirisena when he was serving as Mahaweli Development Minister between 2005 and 2006 is likely to receive Presidential Clemency, counsel for the accused appellant informed the Court of Appeal yesterday.

Accordingly, the Court of Appeal allowed the accused to withdraw an appeal filed challenging the High Court conviction.

The accused Sivaraja Jenivan alias Mohommadu Sulthan Cader Mohideen also known as Senan was found guilty for the attempted, murder charge and sentenced to 10 years rigorous imprisonment by Polonnaruwa High Court on July 3, 2015.

However, the accused filed an appeal in the Court of Appeal challenging the High Court conviction. He requested for an order to set aside the conviction and be released .

Filing a motion in Court, senior counsel U.R. de Silva moved to withdraw the appeal citing that the presidential pardon is likely to be granted to the accused. Counsel further informed Court that the presidential pardon would most probably be granted today (8). Apart from the sentence, Polonnaruwa High Court Judge had imposed a fine of Rs.10,000 on the former LTTE cadre. He was ordered to serve an additional one year sentence sans labour if he fails to pay the fine.

The 37 year old accused is a resident of Koviladi in Jaffna. He was apprehended while traveling in a bus from Polonnaruwa to Batticaloa on April 23, 2006
